Chandigarh: State Consumer Forum orders Unitech & Alice Developers to refund Rs 58 lakh
The State Consumer Disputes Redressal Forum has directed Unitech Limited and Alice Developers Private Limited to refund Rs 29.06 lakh and Rs 28.68 lakh to two complainants for failing to give timely possession of flats booked by them in their residential project under the name ‘Unihomes’ situated in Mega Township, Uniworld City, Sector 107, Mohali.
Two complaints were filed by Muni Devi of Rohtak, Haryana, and Hardev Kumar Kansal, a resident of Sector 51, Chandigarh. In both complaints the complainants were the original allottees and had sought refund of the amount deposited against the price of their respective units, along with interest, compensation, etc.
Both complaints were disposed of by a single order. As per the agreement, the possession of the unit was agreed upon to be given within 36 months from the date of signing of the related documents. It was further stated that before giving possession, it was incumbent on the opposite parties to give notice to the complainant in case of delay in handing over the possession of the unit beyond the period of 36 months.
Devi said that when possession of the unit was not given by the stipulated date she visited the site and was shocked to see that there was no development. Basic amenities such as roads, water, drainage system, electricity were non-existent. It was further stated that despite numerous requests to complete the construction and deliver the possession of the unit, nothing was done even after seven years.
In their reply, the realtors stated that the unit in question was purchased for future gain, as such the complainant being an investor would not fall within the definition of consumer. The forum stated that the realtors were under obligation to compensate the complainant for inflicting mental agony and causing physical harassment.
