NCDRC issues non-bailable warrants against 3 partners of realty firm in Pune
The National Consumer Disputes Redressal Commission (NCDRC) has directed non-bailable warrants against three partners in a Pune based realty firm in a case of execution of its February 17, 2016 order.
In February last year, the commission had directed KDS Infra Buildcons on NIBM Road in Kondhwa to refund Rs 1.34 crore to 132 homebuyers with 18% per annum interest and Rs 4 lakh as damages.
Four months later, the Akhil Bharatiya Grahak Panchayat, which had filed a complaint against the firm, initiated a proceeding for execution of the commission’s order. The three partners are to be produced before the commission at the next hearing on September 22, an order passed by the NCDRC bench of judicial member Ajit Bharihoke and member Anup K Thakur stated on August 25. The NCDRC bench expressed its displeasure over the firm seeking adjournments.
“We are not satisfied with the request for adjournment more so because of the fact that Shri SP Singh is also advocate on record in this case on behalf of the judgment debtors (three partners) and his vakalatnama is also on record. There is no explanation why he is not prepared with the case. Otherwise also, counsel for the decree holders states that the judgment debtors have not paid the principal amount to decree holders despite of directions dated May 19, 2017,” the bench observed and went on to direct the non-bailable warrants.
“The warrants shall be executed by the senior police officer of the police station concerned. In case the warrants are not executed, the SHO of the police station concerned shall appear in person to explain,” the order stated.
