NCDRC stays non-bailable warrants against 3 Pune realtors
The National Consumer Disputes Redressal Commission (NCDRC) has kept in abeyance the non-bailable warrants issued on August 25 against three partners of the Kondhwa-based KDS Infra Buildcons company in a case of execution of its order.
The bench of Justice Ajit Bharihoke and member Anup K Thakur ordered the stay after the three partners appeared before the commission on September 22 and gave an undertaking about their willingness to fully comply with the commission’s order. The bench has posted the matter for next hearing on October 27.
On February 17 last year, the commission had directed the company and its three partners, Bhupendra singh Dhillon, Maruti Budhaji Kadale and Abhijit Maruti Kadale, to refund Rs 1.34 crore with 18% per annum interest and Rs 4 lakh as damages to 132 homebuyers.
The order was in response to a complaint filed in 2012 by consumer body Akhil Bharatiya Grahak Panchayat (ABGP) on behalf of the homebuyers, who had paid varied booking amounts between 2009 and 2010 for ‘KDS Dham’ and ‘KDS Angan’ schemes at Charholi Budruk near Vishrantwadi. The schemes never took off and the company sold the project land to a third party, leaving the buyers in the lurch.
