The Maharashtra Real Estate Regulatory Authority (MahaRERA) Appellate Tribunal has exposed a fabricated story of a developer.

The regulator had initially dismissed the case of a home buyer in November 2017 as the builder had then told the authority that the home buyer had received possession in February 2017, even before MahaRERA came into existence.

Bhavana Duvey, the home buyer appealed against the order, and the tribunal has found that the developer Teerth Realties had only given licence to carry out fit-outs and the Completion Certificate (CC) was received only in March 2018.Thus, the project fell under the ambit of RERA and the tribunal has now asked MahaRERA to hear the case again.
This makes it abundantly clear that a developer allowing a home buyer to carry out fit-outs before receiving Occupancy Certificate would not construe complete possession or delivery.
