Govt may exempt Jaypee homebuyers from filing claim forms
The government and the Insolvency and Bankruptcy Board of India are considering a move to exempt homebuyers in Jaypee Infratech from the requirement of filing a claim form.
According to media reports, the issue was discussed during a meeting in the ministry of corporate affairs on Monday and it was felt that the government and IBBI need to issue the required clarification under the law.
Based on the clarification or the notification from either the government or IBBI, the insolvency resolution professional (IRP) will issue the requisite advisory to homebuyers who have time until Thursday to file a claim.
Amid the confusion over which form to fill up, the IBBI had only last week issued a new claim form – Form F – for homebuyers, which separated them from banks and other creditors, when it came to staking a claim. It had also given flexibility to file the claim in any form and had waived the requirement to immediately submit proof.
While several homebuyers have already filed claims, many have been complaining about the requirement to provide detailed information. But whenever in the future homebuyers get their flat or seek money, they will need to complete the required paperwork.
