The developer should mandatorily display the sanction plan at the project site
Many builders dupe buyers by not sticking to the approved sanctioned plan while many buyers are kept in dark regarding the same. Considering the growing number of complaints, the Maharashtra Real Estate Regulatory Authority (MahaRERA) issued a circular making it mandatory for developers to display the approved sanctioned plan and layout plan along with specifications at the project site of the housing projects in line with a recent Supreme Court order.
A few developers built an 18-storey instead of approved 12-storey building and do not inform the same to buyers. The result of which, the buyers who book houses above approved floors, gets duped. Along with this, many buyers are not tech savvy because of which they are not able to access website and extract the information of the layout in one go.
While hearing the case of Ferani Hotels Pvt Ltd vs State Information Commissioner, Greater Mumbai, the Supreme Court in its September 27 had observed, “We would like to say that keeping in mind the provisions of RERA and their objective, the developer should mandatorily display at the site the sanction plan. The provision of sub-section (3) of Section 11 of the RERA require the sanction plan/layout plans along with specifications, approved by the competent authority, to be displayed at the site or such other places, as may be specified by the Regulations made by the Authority.”
